Policies

Webignite policies

Our policies explain how digital services are delivered, how payments and cancellations are handled, when refunds are assessed and how personal information is processed.

Company information and policy applicationWho we are, how to contact us and how these policies apply

1 Company information

Webignite means Webignite (Pty) Ltd, registration number 2026/243360/07, with its registered office at 10 Apricot, 20 Glen Avenue, Equestria, Pretoria, Gauteng, 0184, South Africa. Webignite is domiciled in South Africa, and this address is its address for service of legal documents. Our website is https://webignite.co.za. Service, payment, cancellation and privacy enquiries may be sent to info@webignite.co.za. Our customer-service telephone number is 082 609 3350, or +27 82 609 3350 when calling from outside South Africa. Our ordinary business hours are stated below.

2 Applicable agreements

Webignite provides digital services, including hosting and separately scoped website, design, development and related work. The services, allocations, fees, payment stages and exclusions are those recorded in the accepted quotation, accompanying scope document or other written agreement.

Hosting provides the agreed server resources for a website and, where included, email through infrastructure supplied by xneelo. Website design and development produce the agreed website or separately assigned component. Maintenance and support cover the tasks or service allocations expressly agreed. Graphic design, branding, content and marketing services are supplied only where included in the accepted scope.

Project services, hosting, ongoing services and Managed Website Plans are distinct service arrangements. A policy describing one service does not make that service part of another engagement. Request the applicable full agreement from info@webignite.co.za before accepting a quotation or subscribing to a service if it has not already been supplied.

3 Interpretation and changes

Business Days are Monday to Friday, excluding South African public holidays. Business Hours are 08:00 to 17:00 South African time on a Business Day. Writing includes an email or another electronic message that can be stored and reproduced.

These policies explain Webignite's processes and must be read with the agreement applicable to the service. They do not unilaterally change an accepted price, scope or contractual right. Later publication of a policy does not retrospectively amend an existing agreement. Any required contractual change must follow that agreement's amendment provisions.

Nothing in these policies excludes a right or remedy that cannot lawfully be excluded. Applicable mandatory law prevails over an inconsistent restriction.

Payment and recurring billing policyInvoices, PayFast payments and authorised recurring collections

1 Amounts and payment dates

Fees, deposits, payment stages and recurring charges are those stated in the accepted quotation or otherwise agreed in Writing. Amounts are payable on the agreed payment dates. An invoice records the amount and due date applicable to the agreed payment arrangement and does not, by itself, authorise a new fee or change an accepted price.

Unless another currency is expressly agreed and supported by the payment method, amounts are stated and payable in South African rand (ZAR). The quotation or order confirmation identifies the total charge and any applicable tax or separately payable third-party cost before acceptance.

2 Payment methods and security

The available payment methods are those offered for the relevant invoice or order. They may include electronic funds transfer and PayFast payment links or online checkout. A payment method is not available merely because it is described here.

Where a PayFast-hosted payment page is used, payment credentials are entered through PayFast rather than supplied to Webignite by email or message. Webignite may receive payment status, transaction references and information needed to identify and reconcile the payment. Do not send card numbers, card security codes, passwords or banking one-time PINs to Webignite.

PayFast processes the payment; Webignite remains responsible for supplying its own agreed services and handling related service, cancellation and refund enquiries. The payment options displayed in the live payment process identify the methods available for that transaction. Payment-security information is available at https://payfast.io/security-fraud/.

3 Recurring payments

A recurring payment instruction requires the payer's authorisation through the applicable payment process. The amount, frequency and collection arrangement must be disclosed before authorisation. A change to the service price must comply with the service agreement and any authorisation requirements of the payment provider.

Cancelling a recurring payment instruction does not, by itself, cancel the hosting service or other service agreement. The Client must also give the required service cancellation notice. Conversely, Webignite will arrange for recurring collections under its control to stop for periods after the effective service cancellation date, except for an expressly authorised final amount properly due.

4 Queries and disputed payments

Send payment queries to info@webignite.co.za with the invoice number and transaction reference. A Client who disputes an invoice should identify the disputed amount and reasons promptly. Undisputed amounts remain payable under the applicable agreement. This process does not prevent the exercise of a statutory remedy or a payment dispute right available through the payer's bank or payment provider.

Keep the invoice, order confirmation and payment receipt as your transaction record. Webignite will investigate a reported payment-transaction error within five calendar days after it is reported. The refund-assessment timetable below is a separate process and does not extend that investigation period or a statutory deadline.

Cancellation and refund policyRefund eligibility, assessment and processing timeframes

1 Refund requests

Refund requests must be submitted to info@webignite.co.za and include sufficient information to identify the Client, payment and reason for the request. Include the relevant invoice or order number, transaction reference and supporting information. Webignite may request information reasonably necessary to establish authority, investigate the request or prevent a fraudulent refund.

2 Assessment and decision

Webignite will assess the request and communicate its decision within seven Business Days after receiving the information reasonably required for that assessment. If further information is needed, Webignite will identify it promptly. This assessment period does not postpone a statutory cancellation deadline or a shorter refund obligation imposed by applicable law.

A refund is assessed under the applicable agreement and law, taking account of the reason for the request, services supplied, work performed, unused prepayments and properly authorised third-party commitments. Submitting a request does not automatically establish an entitlement to a refund. Equally, a payment is not automatically non-refundable merely because it is described as a deposit or advance payment.

3 Approved refunds

Where a refund is approved, Webignite will initiate it within seven Business Days after approval, unless applicable law requires a shorter period. Initiation does not mean that funds will reflect in the payer's account within that period. The time taken for funds to reflect depends on the payment provider and financial institution concerned.

Where supported, refunds are processed through the original payment method. Card refunds are returned to the card used for the original payment, in accordance with the payment provider's requirements. If the original method cannot accept the refund, Webignite will agree a lawful, verified alternative with the payer and the payment provider where required. Webignite will provide confirmation when the refund is initiated.

4 Service-specific treatment

For monthly hosting, cancellation ends future service on the effective date determined under the hosting agreement. Fees for hosting already supplied and service supplied during the applicable notice period remain payable, subject to mandatory law. Any prepayment for service not supplied after that date will be reconciled and credited or refunded, less only amounts properly deductible under the agreement and law.

For a project, cancellation does not erase payment obligations for work properly performed or approved non-cancellable commitments. Webignite will provide a reasonable account of those amounts and reconcile any advance payment. Defective or unperformed services remain subject to the remedies in the applicable agreement and law.

Domain registrations, renewals, licences and other third-party purchases may have their own cancellation restrictions. Only restrictions and commitments lawfully applicable to the transaction may be taken into account. A third party's refusal to refund Webignite does not, by itself, override a mandatory right the Client has against Webignite.

5 Statutory rights

Cooling-off, cancellation and refund rights depend on the transaction and applicable law. Nothing in this policy imposes a blanket waiver of those rights, makes every payment non-refundable or requires a Client to await this internal assessment process before exercising a statutory right.

Monthly hosting cancellation and migrationRolling monthly hosting, notice and transfer arrangements

1 Monthly service and notice

Standalone monthly hosting is supplied on a rolling monthly basis without a minimum commitment. The Client may cancel by giving one calendar month's notice in Writing to info@webignite.co.za. The effective date is determined under the applicable hosting agreement and billing arrangement. Webignite will confirm that date, the final account and any migration arrangements in Writing. A statutory right to cancel on different terms remains unaffected.

This monthly hosting arrangement does not change a separately accepted Managed Website Plan, project, domain renewal or other service commitment. Each service must be cancelled under its own applicable agreement.

2 Migration and continuity

The Client should arrange migration of website files, databases, mailboxes and DNS before the effective cancellation date. Migration labour is included only if the accepted scope says so. Otherwise, Webignite will disclose a proposed fee and obtain approval before carrying out separately chargeable migration work.

A website, mailbox or domain may be interrupted if migration or renewal is incomplete when the hosting service ends. The Client should keep independent copies of important data. Domain ownership and transfer rights remain subject to the registrant's rights, registry rules and applicable law.

3 Export and deletion

The export window, post-termination retention period and deletion arrangements are those in the applicable hosting or data-processing agreement. The Client should request export before service ends. Webignite will communicate the applicable export deadline in its cancellation confirmation and will not treat a backup as a promise of continued hosting after cancellation.

Digital service delivery policyHosting activation, project delivery and independently assigned work

1 Delivery methods

Webignite supplies digital services rather than physical goods unless a quotation expressly states otherwise. Delivery may be through hosting activation, a website or staging link, files, account access, publication or another method agreed for the deliverable. There is no physical shipping charge for a solely digital service.

2 Hosting activation

The applicable order or hosting confirmation states the activation arrangement. Activation depends on receipt of the agreed payment, necessary account and domain information, and any agreed migration inputs. Webignite will communicate a material delay and an updated estimate where reasonably practicable. Domain registration, transfer and DNS propagation may affect when the service becomes accessible.

The anticipated activation date or timeframe will be stated in the quotation or order confirmation before the Client commits to the service. Where migration is required, the agreed timeframe must also allow for access to the previous provider and any necessary domain or DNS changes.

3 Project timelines and assigned components

The accepted quotation, accompanying scope document or other written agreement defines the deliverables and any binding milestones. Other dates are estimates. Changes, missing content, delayed access, Client approvals and third-party dependencies may require a revised timeline.

An independently assigned page, urgent repair or other component may be delivered separately from a larger website or engagement. Where payment for that assigned scope is agreed to fall due on delivery, it is not postponed merely because another contractor's work, the wider site, launch or an agency's end-client payment remains outstanding. The applicable agreement defines delivery and the treatment of defects.

4 Questions and defects

Report a delivery issue to info@webignite.co.za with the relevant scope reference, link or file and a description of the problem. Webignite will assess it under the applicable agreement. This policy does not convert an estimate into a guaranteed deadline, an additional request into included work, or defective performance into satisfactory delivery.

5 Geographic and service restrictions

These digital services do not involve physical exports or shipment of goods. Availability of a service in a particular country depends on the accepted scope, applicable law and relevant hosting, platform, registry and payment-provider restrictions. Webignite will identify a restriction relevant to an accepted order before committing to supply it, rather than promising unrestricted worldwide availability.

Privacy noticePersonal information, service providers and your privacy rights

1 Responsible party and contact

Webignite (Pty) Ltd is the responsible party for personal information processed for its own enquiries, quotations, client relationships, payments and business administration. The Information Officer is Eduard Jakob Teichert. Privacy enquiries and requests must be directed to info@webignite.co.za. Our physical address appears in the company information section above.

2 Information and purposes

Depending on your interaction with us, we receive contact and business details, correspondence, quotation and scope information, billing details, payment references, support records and information you provide for the service. Website and hosting systems may also generate technical records, including IP addresses, device or browser information and security logs.

We use relevant information to answer enquiries, prepare quotations, perform agreed services, manage accounts, reconcile payments, investigate support issues, protect systems, maintain business records and meet legal obligations. We use Google Analytics to understand website use, Google Ads and conversion tracking to measure advertising results, and Google Search Console to monitor search visibility and indexing. The information involved depends on the tool and its configuration, and applicable consent and objection rights remain in place.

3 Sources and lawful processing

Information is ordinarily supplied by you or an authorised representative and may also come from the systems and service providers involved in the transaction. We process it on an applicable lawful basis, including steps requested before a contract, performance of a contract, compliance with law, legitimate interests where permitted, or consent where required. Visiting the website is not treated as blanket consent to every form of processing.

You may choose not to provide information, but we may be unable to answer an enquiry, verify authority, process a payment or supply the requested service if necessary information is missing. Where collection is compulsory under law, we will identify the relevant requirement when applicable.

4 Service providers and disclosures

Relevant information may be shared with personnel and contractors who need it for the engagement, xneelo for applicable hosting and infrastructure services, and PayFast for payments made through its service. Google receives the information involved in our use of Google Analytics, Google Ads/conversion tracking and Search Console. The categories of information involved depend on each tool's function and configuration, rather than a general permission to share all Client information.

Information may also be disclosed to professional advisers, a financial institution, a regulator or another authority where reasonably necessary and lawfully permitted or required. Service providers may process information under their own notices or on instructions, depending on their role. PayFast's privacy notice is available at https://payfast.io/privacy-policy/ and Google's privacy information at https://policies.google.com/privacy.

5 Security, retention and transfers

Webignite will maintain appropriate, reasonable safeguards for personal information within its control. No security measure eliminates all risk. Do not send unnecessary sensitive information or payment credentials through general enquiry channels.

Information is retained for the purpose for which it was collected and for any lawful accounting, legal, security or dispute-related retention requirement. Service data is handled under the applicable hosting or processing agreement. Information no longer lawfully required will be deleted, destroyed or de-identified as appropriate. Routine backup copies may remain protected until overwritten under the applicable backup cycle.

Use of a provider whose systems are outside South Africa may involve an international transfer. Webignite will ensure that a transfer it makes has a lawful basis under POPIA. A provider's involvement is not a representation that all its systems or processing take place in South Africa.

6 Rights, marketing and complaints

Subject to applicable requirements and lawful exceptions, you may request confirmation of processing, access to your information, correction or deletion, object to processing, or withdraw consent where processing relies on consent. Withdrawal does not retrospectively invalidate lawful processing already performed. We may reasonably verify identity and authority before responding.

Electronic direct marketing will be handled in accordance with applicable law. You may use the unsubscribe method in a marketing message or contact info@webignite.co.za. Necessary service, billing and security messages are not automatically stopped by a marketing opt-out.

You may raise a concern with our Information Officer or lodge a complaint with the Information Regulator. The Regulator's current contact details and complaint procedures are available at https://inforegulator.org.za.

7 Information processed for clients

Where Webignite hosts or handles information solely on a Client's instructions, the Client ordinarily determines the purposes of that processing and Webignite acts as an operator. The written processing arrangement governs that work. Requests about a Client's own customer or user information will be referred to that Client where appropriate. This notice does not replace the Client's own privacy notice.

Website use and records accessWebsite content, third-party links and access to information

1 Website content

Website information describes Webignite's services and does not replace an accepted quotation or individual scope document. Examples and portfolio items do not promise an identical result for another engagement. Website content and branding remain subject to the rights of their lawful owners.

Visitors must not use the website to distribute malicious material, attempt unauthorised access, infringe another person's rights or interfere with its operation. A link to a third-party site does not make that site part of Webignite's service. The relevant provider's terms and privacy notice apply to its own site.

2 Records and PAIA requests

Requests for access to Webignite's records may be directed to Eduard Jakob Teichert at info@webignite.co.za. Where PAIA applies, requests must satisfy the applicable statutory requirements and use the prescribed procedure. The Information Regulator's guide, forms and complaint information are available at https://inforegulator.org.za/paia/.

This records-access information is not a substitute for Webignite's PAIA Manual. Privacy access requests and PAIA records requests will be considered under the law applicable to the particular request.
